Deep Learning and the Principle of Distinction: Regulatory Mechanisms and Geopolitical Scenarios in AI-Driven Warfare

Abstract
This study examines the epistemological and operational challenges posed by Artificial Intelligence (AI) in modern warfare, focusing on its transformative impact on international law, strategic doctrine, and geopolitical balance. Combining qualitative analysis of strategic documents and system dynamics modeling, the article addresses three main questions: (1) how deep learning architectures undermine the principle of distinction, (2) algorithmic risk reduction mechanisms in asymmetric conflicts, and (3) emerging geopolitical patterns under AI-driven power dynamics; and presents three proposed models. At each stage, dynamic modeling was used to examine variables and components related to the topic so that the model could be examined in a constantly evolving environment and best adapted to the complexities of the real world. The analysis reveals a technical-legal paradox: while AI offers unprecedented precision on the battlefield, it disrupts traditional notions of human control, accountability, and compliance with ethical principles through algorithmic agency, challenging the principle of distinction. This article attempts to examine the impact of AI in future warfares from the perspective of the principle of distinction.
